  • There is a profound difference between res communes omnium, in which there were unlimited resources available, which were not be onwend by anyone and so accessible to all human beings as such, and res publicae. Among these res, following Marciano's enumeration, there were the air, the aqua profluens, the sea and consequently the seashore, that more than any other thing included in the same cathegory enjoyed a peculiar legal discipline, highlighted in case of the construction of a building on a portion of the seashore.
