  • Etymologies flourished in legal language from the late Roman Republic. The ancient etymology was based on the formation of another word in order to create a phonic resemblance between terms and suggest a common root. Etymologies are almost all false on the philological level. However their wrong nature reveal their function. The etymology is source of arguments. The modern Romanists see usually legal etymologies by Quintus Mucius Scaevola and Servius Sulpicius Rufus show that the etymology is beyond the definitional processes. On the contrary the etymology may constitue a suggestive projection of existing or developing legal rules or allow providing a new interpretation of existing regula iuris.
