  • The paper deals with the analysis of the manumissio testamento as a complex juridical fact with progressive formation. Thorough scrutiny is applied in respect of a doctrine under which the manumissio testamento commited to a creditor's detriment (fraus creditori) is simply inefficient and rescindable upon the creditor's request, whereas the prevailing doctrine considers it null and void. Particular attention is paid to the following sources: Gai 1.47; D. 42.8.15 (Iul.49 dig.); D. 40.7.1.1 (Paul. 5 ad Sab).
