Regulation (EU) No 650/2012 on jurisdiction, applicable law, recognition and enforcement of decisions and acceptance and enforcement of authentic instruments in matters of succession and on the creation of a European Certificate of Succession, generates a self-sufficient private international la microsystem and represents the model on which the EU lawmaker has built the Regulation Nos 2016/1103 and1104 concerning the cognate subject of matrimonial property regimes and the property consequences of registered partnerships. Regulation No 650/2012 portrays the increasingly central role that the individual is taking, also in the resolution of conflicts of laws. In espousing a one-side approach in the choice of the applicable law, typical of succession matters, the EU lawmaker has gone so far as to limit the range of laws that may be designated, anchoring all of them to the nationality of the deceased. For the first time, the choice of a law is permitted which, at he time of designation, is not yet known: the choice, that is, is anticipated, and which it - in select cases - the conflict of laws which is perequisite for the application of the Regulation. No material corrective has been foreseen and, for the first time, the application of the overriding mandatory provisions of the lex fori is not explicity permitted.
