El presente trabajo tiene por objeto el análisis del silencio de la Comunidad de Propietarios unido al transcurso del tiempo en aquellas casos en que se realizan obras que alteran los elementos comunes del edificio sin el preceptivo consentimiento de todos los propietarios, conforme a los criterios de las sentencias del Tribunal Supremo, considerando el relativismo y la disparidad de supuestos que se dan en dicha materia.

The purpose of this paper is analyzing the silence of the Homeowners’ Association and the passage of time in those cases in which works are carried out that change the common elements of the building without the permission of all the owners, according to the criteria of the sentences of the Supreme Court, considering the relativism and the disparity of cases that take place in this subject
