  • Now we know how Labeo had treated the technical term of contract /contractus/, as used under the Pretorian Edict, known during the late Republic, though we possess only a shortened version of it, written by Ulpian after its codification made by Julian. Nonetheless we could verify the wording of the first-century enatment, seeing in it a binding duty to give something in exchange of another -already received by the debtor. There Labeo had made a parallel with the Greek term of synallagma, in his efforts to explain the corresponding Latin phrase "ultro citroque", where the contract had resulted from. This legal concept had corresponded in Labeo's times to the practice of permutation of valuable objects as means of their overseas transportation.
