Resumen de Ancora su Vittorio Sciajola (ed Emilio Betti)

Emanuele Stolfi

  • This article examines some aspects of juridical thought and political vision of Vittorio Scialoja and Emilio Betti, discussing the recent Brutti's reconstruction about these jurists. The author analyzes especially their role in the research field of Roman law, and generally in the Italian juridical culture between 19th and 20 th centuries. ES pecially relvealing seem not only their theories about some important concepts of private law ("negozio giuridico", "atti emulativi", "causa", ecc.), but also the relations between technical solutions and political ideas (the conservative liberalism of Scialoja in opposition to the Betti's agreement to the fascism).
