    • In D. 9.2.31 Mucius Scaevola is presented as having introduced a refined concept of culpa as liability criterion for wrongful damage. But the text shows an internal contradiction. To lift this, it is submitted that Scaevola put passing over private land at a par with passing over public land if this happened often enough. It would be in line with the restricted extension of iniuria we find with other authors of the first century BC. The references to culpa would have been inserted in the second century AD.
