    • Roman Law considered the concept of obligation capable of fulfilling the function of personal security of a debt, exceeding the archaic model of hostages. The Roman legislation has tried to modify the rigidity of the regime of the "oportere ex sponsione" to the function of personal security. The Roman jurists have adjusted through their interpretation in law this regime to fix it as an obligation related to a principal debt in terms of accessoriness. The most important rule seems to have been the limitation of durior condicio, mandatory limitation for the Roman jurists, which, if passed, would make the obligation of security no longer tied to the principal obligation and therefore null and void.
