Basta un Codice alla Chiesa?: Interpretazioni, integrazioni e sviluppi dopo il 1983

    The 1983 Code has substantially resisted the challenge of time, overcoming the objections of those who have judged it structurally inadequate to transpose in a faithful and efficient manner the ecclesiology of Vatican II. The contribution traces the ulterior normative interventions accomplished in the period following its promulgation: the authentic interpretations, the declarations and explanatory notes of the Pontifical Council for Legislative Texts; the integration and changes to the text of the Code; universal laws that in a certain way were complementary to the Code. There is also mention of the most singular technique adopted in the process of the Reform of the Roman Curia and of some other issues that deserve further profound analysis and of specific normative dispositions.

    Il Codice del 1983 ha sostanzialmente retto alla sfida del tempo, supe­ rando le obiezioni di quanti lo giudicavano strutturalmente inadeguato a trasporre in maniera fedele ed efficace l'ecclesiologia del Vaticano II. Il contributo ripercorre gli ulteriori interventi normativi intercorsi nel periodo successivo alla sua promulgazione: le interpretazioni autentiche, le dichiarazioni e le note esplicative del Pontificio consiglio per i testi legislativi; le integrazioni e le modifiche al testo codiciale; le leggi uni­ versali in certo modo complementari al Codice stesso. Si accenna poi alla singolare tecnica adottata nel processo di riforma della Curia Romana e si indicano alcune questioni meritevoli di ulteriore approfondimento e di specifici provvedimenti normativi.
