Il bicameralismo in Italia: un nodo (ancora) in attesa di soluzione

    The Aim of this essay is to briefly deal with the problem of the Italian bicameral system from three points of view . First of all, the essay focuses on the historical evolution of the Italian bicameral system, starting with the ambiguities of the original choices of the constituent assembly. Secondly, the present paper wants to analyze the many failed constitutional reform attempts, up to the last proposed by the Renzi Government and refused by the referendum of December 4, 2016. Finally, the essay tries to outline the possible paths of development of the Italian bicameralism, without a constitutional reform, taking into account both the most recent constitutional jurisprudence on electoral laws, and the persistent need to involve territorial autonomies in national legislative procedures

    Il contributo affronta il tema delle criticità del sistema parlamentare bicamerale italiano da tre punti di vista. Innanzitutto, quello della evoluzione storica del modello bicamerale paritario, a partire dalle incertezze che lo caratterizzarono fin dalle scelte originarie in Assemblea costituente. In secondo luogo, quello dei molteplici tentativi di riforma costituzionale falliti, fino all’ultimo sostenuto dal Governo Renzi e non approvato dal referendum del 4 dicembre 2016. Infine, quello delle possibili prospettive future, a Costituzione invariata, tenendo conto della più recente giurisprudenza costituzionale sulle leggi elettorali e della perdurante esigenza di coinvolgere le autonomie territoriali nei procedimenti legislativi nazionali.
