Resumen de La sentencia del Tribunal Constitucional Federal de Alemania sobre las “OUTRIGHT MONETARY TRANSACTIONS”

Con su sentencia de 21 de Junio de 2016, el Tribunal Constitucional Federal de Alemania ha puesto fin al suspense creado por la cuestión prejudicial que él mismo elevó al Tribunal de Justicia de la Unión Europea a propósito de las “Outright Monetary Transactions” del Banco Central Europeo. El Tribunal Constitucional acepta la interpretación del Tribunal de Justicia y desestima los recursos interpuestos en Alemania contra el programa OMT. El presente artículo propone analizar la sentencia desde el punto de vista procesal y sustantivo a la luz de los comentarios escritos por la doctrina jurídica alemana. Se pondrán así de relieve las novedades que la sentencia aporta a la dogmática constitucional alemana sobre la integración europea y las muchas preguntas que estas novedades implican. Este proceso puede haber servido para pacificar las relaciones entre el TC alemán y el TJUE, pero ha puesto también de manifiesto los límites de ambas jurisdicciones.

The judgment of the German Federal Constitutional Court of 21st June 2016 put an end to the suspense that this Court’s reference for a preliminary ruling to the Court of Justice of the European Union about the Outright Monetary Transactions of the European Central Bank had created. The Constitutional Court accepts the interpretation of the Court of Justice and rejects the applications lodged against the OMT programme. This article proposes a procedural and substantive analysis of the judgment in the light of the German scholarship published. It will put an emphasis on the novelties this judgment brings for German constitutional dogmatic about European integration and on the many questions that derive from them. The OMT process has probably contributed to settle the relations between the German Constitutional Court and the Court of Justice, but it has also revealed the limits of their jurisdiction.
