This article focuses on an order of stay proceedings - issued by the Italian Supreme Court pursuant to Article 7(3) of the Law reforming the Italian system of private international law (Law No 218/1995) - over a performance bond claim to allow the decision of a technical preliminary issue. Through the analysis of the legal reasoning inthe Supreme Courts's decision and the scrutiny of the relevant applicable provisions, the author reaches the conclusion that the Supreme Court's order is in keeping with the doctrine and the jurisprudence on this matter.
