Resumen de O bem jurídico-penal europeu e a competência legislativa em matéria penal da União Europeia

This study deals with the european criminal law. This is new branch of legal science. With the consolidation of security, freedom and justice in the Treaty of Lisbon 2007, hás been an emerging european criminal law, but with problems in its incidence and extent. His technical and legal construction, necessarily involves the definition of decent legal and criminal protection. In this paper, we try to demonstrate, from the EU Treaties, a guideline the systematization of this object legal european criminal, especially marked by the principles of necessity and subsidiarity of criminal law. The European criminal law intervere through its policies on the basis of national legislation, notwithstanding its effectiveness before the bodies of the Union, especially in the Court of Justice of the European Union.

Este estudo versa sobre o direito penal europeu. Trata-se de ramo novo da ciência jurídica. Com a consolidação do espaço de liberdade, segurança e justiça, no Tratado de Lisboa de 2007, tem-se um direito penal europeu emergente, mas com problemas na sua incidência e extensão. Sua construção técnico-jurídico passa necessariamente pela delimitação do bem jurídico digno de tutela penal. Neste paper, tenta-se demonstrar, a partir dos Tratados da União Europeia, uma diretriz à sistematização deste bem jurídico-penal europeu, marcado sobretudo pelos princípios da necessidade e da subsidiariedade do direito penal. O direito penal europeu interfere por meio das suas diretivas nas bases das legislações nacionais, sem embargo de sua efetividade perante os órgãos da União, especialmente no âmbito do Tribunal de Justiça da União Europeia.
