  Matter to this work question what meaning currently leads the plea bargaining practices and, above all, which the confessional motto that guides. It analyzes, before veridiction schemes, the considerations and rollaway strategies tipoff by confession operator: (1) remember the principle reinserting the implicit pact on which is founded the sovereignty of the judicial institution and is a punitive commitment giving meaning the penalty imposed; and (2) a kind of “real contract” allowing who understands with a knowing beyond doubt, so its drift to the trivialization. In short, for these outlines the history of legal and criminal thinking, better bolster the reflections on the ammunition of the punitive power of the resulting mechanisms of plea bargaining.

  Importa ao presente trabalho questionar qual o sentido que conduz atualmente as práticas de delação e, sobretudo, qual o mote confessional que a orienta. Para tanto, analisa, diante dos regimes de veridição, as estratégias aduzidas e desdobráveis da delação pelo operador da confissão: (1) recordar o princípio reinstaurando o pacto implícito sobre o qual se funda a soberania da instituição judicial e constitui um compromisso punitivo que dá sentido à sanção imposta; e (2) por uma espécie de “contrato de verdade”, permitir a quem julga saber com um saber indubitável, por isso sua deriva à banalização. Em suma, por estes contornos da história do pensamento jurídico-criminal, melhor se amparam as reflexões sobre as munições do poder punitivo advindas dos mecanismos delatórios.
