La regulación del Impuesto sobre el Incremento del Valor de los Terrenos de Naturaleza Urbana ha sido siempre objeto de crítica. Desde los comienzos de la crisis, este impuesto está gravando en muchas ocasiones una capacidad económica inexistente o, en el mejor de los casos, superior a la verdadera. Las STC 26/2017 y STC 37/2017, (referidas a Normas forales sustantivamente similares a la estatal) han declarado inconstitucional la regulación en determinados supuestos. En este artículo se analizan, junto a dichas sentencias, la jurisprudencia y doctrina sobre la cuestión y se realizan propuestas de lege ferenda para superar la insatisfactoria situación actual
The regulation of the Tax on the Increase of the Value of the Land of Urban Nature has always been object of criticismo Since the beginning of the crisis, this tax is often applied in cases where there is no economic capacity or, at best, when the existing one is minimal. The STC 26/2017 and STC 37/2017, (referríng to Foral rules, similar to the state regulations) have declared the regulation unconstitutional in certain cases. In this article, we analyze, together with these judgments, the case-law and legal scho- larship on the question and make lege ferenda proposals to overcome the current unsatisfactory situation
