O uso da mediação nos delitos sexuais: o resgate da dignidade da vítima

    By analysing the role of the victim of sexual offense in the process of composing the penalty to the offender, it becomes evident that the victim's rights are violated twice once the formal authorities of social control also judge her for her moral and sexual behavior before considering her narrative valid and, therefore, criminal evidence. This is potentially enhanced by our eminentially patriarchal based values society. It then exposes the institutional violence to what the victim is submitted to, besides the inefficiency, or the inverted efficiency, of the criminal response to prevent new sexual assaults. In this context it is necessary to search for new alternatives apart from the traditional criminal law solution, which would bring back the protagonism to the victim and consolidate an effective and preventive response. This paper proposes the use of mediation, which is part of the Restorative Justice.

    Ao analisar o papel da vítima do delito sexual no processo de composição da sanção ao algoz, verifica-se que a mesma tem seus direitos duplamente violados quando passa, ela também, a ser julgada por sua conduta moral e sexual pelas instâncias formais de controle social, a partir de valores eminentemente patriarcais, a fim de validar a sua narrativa e, assim, a prova criminal. Escancara-se, então, a violência institucional a qual é submetida, além da ineficácia – ou a eficácia invertida – da resposta penal à prevenção de novas agressões sexuais. Neste contexto, é necessário buscar alternativas à solução jurídico-penal tradicional, que devolvam à vítima o seu protagonismo e constituam uma reposta efetivamente preventiva. Neste trabalho, propõe-se o uso da mediação, integranteda chamada Justiça Restaurativa.
