Regulation (EC) No 1082/2006 - recently amended by Regulation (EU) No 1302/2013 - introduced the European Grouping of Territorial Cooperation (EGTC), a legal entity devoted to the realisation of the transfrontier cooperation programme disigned by its members. The EGTC has been provided with a broad legal capacity which enables it to enter into legal relationships with third parties, but has also been entrusted with the possibility to asopt, to some extent, acts governed by public law. As far as private law relations of the EGTC are concerned, jurisdiction and applicable law might be easily identified according to EU private international law instruments, while the attribution to a transfrontier entity of the authority to adopt acts governed by public law (and traditionally regulated bay national laws on a strictly teritorial basis) creates unexplored legal issues. In this view, the present cpntribution aims at identifying the applicable law as well as the rules of jurisdiction concerning emplyment contracts and public procurement procedures of the EGTC.
