Resumen de La adquisición del derecho sucesivo del fideicomisario

En este trabajo pretendemos hacer una reflexión acerca el inciso final del artículo 784 del Código civil, cuando afirma que «el derecho de aquel pasará a sus herederos». ¿Qué alcance tiene esta afirmación? El precepto dice textualmente: «El fideicomisario adquirirá derecho a la sucesión desde la muerte del testador, aunque muera antes que el fiduciario. El derecho de aquel pasará a sus herederos». El alcance del artículo 784 del Código civil es mayor del que puede parecer a simple vista, siempre que el nombramiento del fideicomisario no estuviese sujeto a condición alguna.

In this paper, we make a reflection on the final paragraph of Article 784 of the Civil Code, stating that «the right of that will go to your heirs.» How far does this statement? The provision reads: «The trustee will acquire a right of succession since the death of the testator, but dies before the trustee. The right of that will go to your heirs.» The scope of Article 784 of the Civil Code is greater than it may seem at first glance, provided that the appointment of the trustee was not subject to any condition.
