El Derecho no es privativo del ser humano. En el reino animal existen normas o pautas de conducta que son cumplidas por los animales y guardan verdadera similitud con las normas que rigen en el mundo de los seres humanos. El Derecho de la Seguridad Social no es una creación humana, en el reino animal han existido y existen normas para prever y evitar perjuicios (o contingencias). La diferencia entre el Derecho de la Seguridad Social humano y las pautas de previsión presentes en los animales, radica en la mayor complejidad y profundidad de razonamiento intelectual del hombre. En el ser humano, el Derecho de la Seguridad Social es un Derecho vivo, proclive a albergar el nacimiento, mantenimiento y derogación de normas. Con la finalidad de explicar esta dinámica jurídica se ha recurrido a la utilización de la lógica y, más concretamente, a manejar un silogismo simple y complejo con una variable temporal que plasma las tres dimensiones básicas del fenómeno jurídico (sociológica, axiológica y estructural).
