La guarda y custodia compartida: una solución deseable

    La Ley 15/2005, de 8 de julio, modificó el artículo 92 del Código Civil introduciendo en nuestro ordenamiento jurídico la posibilidad de que el Juez, en los casos de crisis de parejas matrimoniales o extramatrimoniales, en las que existan hijos menores de edad, acuerde la guarda y custodia compartida de estos por ambos progenitores. La doctrina del TS en relación con la interpretación del mentado precepto, y los criterios que hay que valorar a la hora de acordar dicha medida, en el supuesto en el que no sea solicitada de común acuerdo entre las partes, han sido fijados en la Sentencia de dicho Tribunal 259/2013, de 29 de abril. En el presente artículo se analizará la doctrina de TS sobre la procedencia de la adopción de la guarda y custodia compartida, lo criterios fijados por la Jurisprudencia de dicho Tribunal en relación con la misma, y cómo se están aplicando por la jurisprudencia menor.

    Act 15/2005, of 8 July, amended Section 92 of the Civil Code, introducing in our legal system the possibility that the judge, in cases of crisis of marital or extramarital couples in which there are minor children, agree to the guardianship and custody of these children by both parents. The doctrine of the Tribunal Supremo (Supreme Court) in relation to the interpretation of the quoted provision, and the criteria that need to be assessed when agreeing on such a measure, in the assumption when it is not requested by mutual agreement between the parties, have been laid down in the judgement 259/2013, of 29 April, of that Court. In this article, we will analyse the doctrine of Tribunal Supremo on the origin of the adoption of the joint-custody, the criteria laid down by the case law of that Court on that matter, and how those criteria are being implemented by the minor case law.
