Por paradójico que resulte, la regulación legal de los daños ocasionados en la construcción a edificios próximos no quedó comprendida en la Ley 38/1999 de Ordenación de la Edificación, de ahí que haya que acudir a la responsabilidad civil extracontractual del artículo 1902 del C.c. y sobre todo, a nuestra jurisprudencia, para comprender su alcance. ¿Pero quién es quién en una obra? ¿Quién debe responder por este tipo de daños?
Paradoxical as it may seem, the legal regulation of the damages caused by the construction of future buildings is not well understood in the building management Act 38/1999, thus we have to turn to civil non-contractual liability of the article 1.902 of the Civil Code and above all to our jurisprudence, in order to understand its scope. So who is who in a construction? Who is the responsible for that kind of damages?
