  La Ley 26/2015, de 28 de julio, de modificación del Sistema de Protección a la Infancia y a la Adolescencia introduce cambios en el artículo 1263 C. c. relativo a la capacidad exigible a las partes para celebrar un contrato plenamente válido y eficaz. Con esta reforma se reconoce expresamente que el menor no emancipado tiene capacidad contractual. Una interpretación finalista del precepto, acorde con lo dispuesto por la Ley Orgánica 1/1996, de 15 de enero, de Protección Jurídica del Menor, aconseja evitar restringir esta capacidad, salvo que la ley establezca lo contrario; siempre y cuando el menor actúe en un ámbito propio de su edad y le acompañe la madurez suficiente para comprender los efectos del contrato celebrado.

  The Law 26/2015, of 28 July, about modification of the System of Protection to Childhood and Adolescence, introduces changes in the article1263 of the Civil Code relating to the required capacity to the contracting parties to conclude a contract fully valid and effective. With this reform the law recognized clearly the non-emancipated minor has contractual capacity. A finalist interpretation of the precept, that it also is in agreement with the Law 1/1996 of 15 January, about Legal Protection of Minor, advised to avoid restricting this ability, unless the law provides otherwise; whenever the minor concludes a suitable contract for his age and has the sufficient maturity to understand the effects of the contract concluded
