  This article tackles the importance of the European Social Charter in the defense of the social rights of older people in the context of the major social and economic crisis that is affecting Europe. In a Europe that is dominated by competitiveness concerns and economic interests, the intervention of the European Committee of Social Rights and the European Social Charter, play an essential role on the maintenance of the social rights of the European citizens, especially of the most disadvantaged population groups. The protection afforded by the European Social Charter and the national law to the rights of older people is identified, as well as the way our country has been trying to respond to the demands placed upon him by the European Social Charter in this area.

  Este artigo trata da importância assumida pela Carta Social Europeia na defesa dos direitos sociais das pessoas de idade dos países signatários, no contexto de crise social e económica que a Europa atravessa. Numa Europa dominada por preocupações de competitividade e por interesses económicos, a intervenção do Comité Europeu dos Direitos Sociais e a Carta Social Europeia, têm um papel fundamental na preservação dos direitos sociais dos cidadãos, sobretudo dos grupos mais desfavorecidos da população. Neste sentido, identificam-se os direitos sociais dos idosos garantidos pela Carta, os pedidos de informação e de colocação em conformidade feitos pelo Comité dos Direitos Sociais ao nosso país neste domínio, e a situação actual da legislação nacional em sede de tutela dos direitos sociais das pessoas mais velhas.
