Populismo punitivo en España (1995-2015): presión mediática y reformas legislativas

    El presente artículo tiene un doble objetivo. Por un lado, explicitar las características del denominado populismo punitivo tras su aparición académica y, por otro, describir interpretativamente cómo y por qué dicho fenómeno se ha dado en España. En este sentido y respecto al primer objetivo, el artículo desglosa, analíticamente, las razones sistémicas que subyacen en dicho fenómeno político y penal, poniendo de manifiesto que dicho fenómeno es la respuesta neoliberal/neoconservadora a problemáticas sociales cuya solución pasa por criminalizar la pobreza, individualizar las problemáticas y adoptar estrategias punitivas y represivas. Respecto al segundo objetivo, el artículo analiza en detalle tres factores ideológicos y políticos consustanciales al populismo punitivo; a saber: (1) la transformación del papel asignado a la cárcel de una institución rehabilitadora a otra exclusivamente represora; (2) la magnificación de la importancia de la opinión de las víctimas, y (3) la politización y el uso electoral del tema de la inseguridad.

    Esto se ilustra con ejemplos paradigmáticos de crímenes mediáticos, opinión pública y reformas penales. El artículo ofrece una amplia panorámica de la introducción del populismo punitivo en el sistema penitenciario español.

    The present article has a double objective. On the one hand, it aims to explain the characteristics of the so-called punitive populism after its academic appearance and, on the other, to interpretively describe how and why this phenomenon has occurred in Spain. In this sense and regarding the first objective, the article analytically breaks down the systemic reasons behind this political and criminal phenomenon, showing that it is the neoliberal / neoconservative response to social problems the solution of which entails criminalizing poverty, individualizing the problems and adopting strategies that are both punitive and repressive. Regarding the second objective, the article analyzes in detail three ideological and political factors that are consubstantial of punitive populism, namely: (1) the transformation of the role assigned to prisons from rehabilitation institutions to exclusively repressive ones; (2) the magnification of the importance of the victims’ opinions; and (3) the politicization and electoral use of the subject of insecurity. This is illustrated with paradigmatic examples of media crime, public opinion and penal reforms. The article offers a broad overview of the introduction of punitive populism in the Spanish penitentiary system.
