Resumen de Die Empfehlungen der Europäischen Kommission vom November 2016 zum EU-Milchpaket
Das EU-Milchpaket von 2012 bildete den Startpunkt für die Konsolidierung und den Ausbau des Agrarkartellrechts im Bereich der anerkannten Agrarorganisationen. Durch die Reform der Gemeinsamen Agrarpolitik 2014/15 wurde das Agrarorganisationenrecht zu einem wesentlichen Ankerpunkt der liberalisierten EU-Agrarmarktordnung. Von besonderem Interesse sind daher die beiden vom EU-Gesetzgeber geforderten Evaluationsberichte der Europäischen Kommission zum EU-Milchpaket. Während der erste Bericht vom Juni 2014 noch weitgehend deskriptiv gehalten war, schließt der zweite Bericht vom November 2016 mit konkreten Empfehlungen ab. Der vorliegende Beitrag möchte die kartellrechtlichen Aspekte dieser Empfehlungen, die mit Blick auf die derzeit beginnende Diskussion über die nächste Reformrunde der Gemeinsamen Agrarpolitik verfasst wurden, analysieren und in Beziehung zu der Zielsetzung des EU-Milchpakets setzen.
The recommendations of the European Commission of November 2016 on the EU Milk Package The EU Milk Package of June 2012 set an important starting point for the consolidation and expansion of the EU competition law in the area of recognized agricultural organisations. The latest reform of the CAP, which came into effect in 2014/15, transferred the Milk Package without significant changes into the revised regulation on the agricultural markets. After having reported on the state of implementation of the Milk Package in June 2014 the European Commission presented its second report on the implementation of the Milk Package in November 2016. The present article recalls the goals and instruments of the Milk Package. Subsequently, it reflects on the interaction between the general agricultural law on competition and the special provisions of the Milk Package. Building on that background, the findings and recommendations of the second report are presented and discussed. As a key conclusion, the report states that in the important milk producing Member States the instruments of the Milk Package are either already implemented or, if they were implemented, would not have a significant influence on the milk sector in these countries. In the light of the present milk market crisis the article raises the question whether the Milk Package contains all necessary instruments to prevent or at least attenuate such crises and reconsiders the weak points of the Milk Package conception.
