  • Der Europäische Gerichtshof hat am 21.07.2016 in der Rechtssache Remonts über die Haftung eines Unternehmens für wettbewerbswidriges Fehlverhalten (wirtschaftlich) selbstständiger Dienstleister entschieden. Im Hinblick auf die Haftung für eigene Mitarbeiter bestätigt die Entscheidung das Konzept der abstrakten Verantwortlichkeit: Das Unternehmen haftet grundsätzlich für alle aus der wirtschaftlichen Einheit heraus begangenen Kartellverstöße. Die Haftung für Kartellverstöße selbstständiger Dritter begründet der EuGH ebenfalls abstrakt; er bindet sie jedoch mit Recht an restriktivere Kriterien, die im Kern auf eine vorsätzliche oder qualifiziert fahrlässige (indirekte) Kartellbeteiligung des Unternehmens hinauslaufen.

    Liability and Attribution in EC-Competition Law On July 21st 2016 the European Court of Justice held, that an undertaking may be held liable for the infringement of EU competition law on account of the acts of an independent service provider supplying it with services (Remonts). First of all, the Court emphasizes the liability of an undertaking for any anticompetitive conduct of it’s own employees, and stresses that the undertaking is, as a matter of principle, held liable for that conduct. However, this jurisprudence does not translate into an equally broad liability for the conduct of separate undertakings. The article analyses the more restrictive criteria to be met in order to establish liability, i. e. to attribute the conduct at issue to the undertaking using the services. The article also explores the underlying principles of corporate responsibility.
