    On the footsteps of Plato and Kant this paper defines legal idealism as a way of thinking opposed to formal voluntarism in the field of international law. Starting from the model established in the first general book on international environmental law published in 1975 by Alexandre Kiss, it is shown that the authors of the current leading treatises published in French and English are adopting an idealistic point of view in analyzing the challenges faced by this branch of international law. Their teachings are also reflected in international judicial decisions and separate judge opinions. Together they influence as subsidiary means for the determination of rules of law the special orientation of international environmental law.

    Dans la suite de Platon et Kant, la présente contribution définit l’idé lisme juridique comme un courant de pensée opposé au volontarisme formel du droit international. En partant du modèle fourni par le premier manuel sur le droit international de l’environnement publié en 1975 par Alexandre Kiss, il est démontré que les auteurs des principaux ouvrages actuels publiés en langue française et anglaise adoptent une position idéaliste lorsqu’ils analysent les enjeux auxquels est confrontée cette spécialité du droit international. Cette position doctrinale se reflète également dans les décisions de justice internationale et dans les opinions séparées des juges. Ainsi la doctrine et la jurisprudence comme moyens auxiliaires de détermination des règles de droit contribuent-elles ensemble à l’orientation spéciale propre au droit international de l’environnement.
