El fracaso escolar obedece a deficiencias del sistema educativo que se debe ocupar de ayudar al individuo a manejar sus estados emocionales. La necesidad de prevención de conductas antisociales desde la escuela no ha generado una política criminológica adecuada, sólo se aplican paliativos que no funcionan por la falta de visión y de compromiso social. La pedagogía criminológica, para prevenir conductas antisociales, tiene como eje central la formación psíquica sana del individuo con carácter preventivo ya que es necesario replantear la formación del sujeto como ser-social.

Academic failure is linked to deficiencies within the education system, which is meant to help the individual to deal with their emotions. The need of intervention to prevent anti-social behavioural patterns from the school did not generate an adequate criminal policy, only a few temporary solutions which do not work because of lack of vision and social compromise,. The criminological pedagogy, in order to prevent anti-socail behaviour should consider, as its central axis, the healthy training of the individual´s psyche. Thinking about the "crisis of values", therefore it is necessary to rethink the notion of the individual´s education as a social-subject.
