La incidencia en el deporte de las leyes de Procedimiento Administrativo Común y de Régimen Jurídico del Sector Público

    La entrada en vigor de la Ley 39/2015, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas (LPAC) y de la Ley 40/2015, de 1 de octubre, de Régimen Jurídico del Sector Público (LSP), ambas en la misma fecha del 2 de octubre de 2016, deben tener una amplia incidencia en el ámbito del Derecho Público, en general, y del Derecho Administrativo, en particualr. Atendiendo a las principales determinaciones de estas normas, nos centraremos en el efecto de las mismas en el ámbito del deporte. En primer lugar, en la organización deportiva de la Administración general del Estado. En segundo lugar, en los efectos que sobre los procedimientos que se tramitan en el mismo ámbito ha de tener la aprobación de la LPAC, prestando especial atención a los que se desarrollan por las Federaciones deportivas españolas en el ejercicio de funciones públicas delegadas.

    The entry into force of the Spanish Act 39/2015 of the Common Administrative Procedure of Public Administrations (LPAC) and the Act 40/2015, of the Legal Regime of the Public Sector (LSP), both on the same date of October 2, 2016, should have a wide impact in the field of Public Law, in general, and Administrative Law in particualr. Taking into account the main determinations of these rules, we will focus on their effect in the field of sport. First, in the sports organization of the State General Administration. Secondly, in the effects on the administrative procedures in the same area that must have the approval of the LPAC, paying special attention to those that are developed by the Spanish sports federations in the exercises of delegated public functions.
