      En el presente trabajo se aborda el estudio de la institución del Ministerio Fiscal como órgano de relevancia constitucional, para averiguar si goza de verdadera autonomía frente a los poderes del Estado, básicamente el ejecutivo. Para ello se analizan los principios que rigen su actuación, esto es, legalidad, imparcialidad, unidad de actuación y dependencia jerárquica, así como el punto neurálgico del sistema de nombramiento y cese del Ministerio Fiscal en el proceso penal y si la figura de un fiscal investigador garantizaría la imparcialidad de la justicia penal.

      In the following article we tackle the study of the Attorney General's office as an organ of constitutional relevance to find out if it has true autonomy when facing the powers of the state, in truth the government. To achieve that we analyze the principles which regulates its acts, that is to say, legislation, impartiality, unity in interventions and hierarchical dependency, as in the crucial form of the namig and the cessation/dismissal of the Attorney General. The second part is focused on the standing of the Attorney General's office in the penal process and if the figure of the State Prosecutor can warrant the impartiality of penal justice.
