Medidas sancionatorias, determinación legal y su implementación como justicia restaurativa al servicio de la comunidad

    La implementación eficiente de la justicia restaurativa, así como la puesta en práctica del espíritu normativo que consagra la Ley 1098 de infancia y adolescencia de atender el interés superior del niño y buscar su protección integral, hacen pensar en desarrollar medidas sancionatorias cuya intencionalidad tenga carácter, protector,educativo y restaurativo, la prestación de servicios a la comunidad por parte de los menores infractores en el municipio de San Gil es el vehículo expedito para alcanzar dicho objetivo. El presente artículo, se propone efectuar un análisis de los contextos y conceptos socio-jurídicos e interdisciplinarios que enmarcan la propuesta.

    Abstract: The efficient implementation of restorative justice and the implementation of the regulatory spirit Act 1098 enshrines children and adolescents to address the interests of the child and to seek full protection, they think about developing punitive measures which have an intent character, protector, educational and restorative, with the provision of community service by juvenile offenders in the Judicial District of San Gil, the expeditious vehicle to achieve that goal. This article proposes an analysis of the contexts and socio-legal concepts and interdisciplinary framing the proposal.
