Auf der Zielgeraden der GWB-Novellierung sind nur noch wenige Punkte strittig. Sie werden in diesem Beitrag einer Analyse unterzogen. Nach Auffassung der Autoren ist die Schließung der „Wurstlücke“ durch die Übernahme des europäischen Unternehmensbegriffs rechtlich möglich und in der Sache vertretbar. Bei der Umsetzung der Schadensersatzrichtlinie sollte der Offenlegungsanspruch weniger einschneidend ausgestaltet werden. In der Verbraucherrechtsdurchsetzung gibt es punktuell Ergänzungsbedarf zur privaten Rechtsdurchsetzung; das Bundeskartellamt könnte dies leisten. Hier ist aber zunächst eine „kleine Lösung“ angemessen. Das Ministererlaubnis-Verfahren kann durch eine Verordnung oder Leitlinien besser strukturiert werden. Kaum einer Erwähnung bedarf es, dass Ausnahmen vom Wettbewerbsprinzip rechtlich und ökonomisch nicht sinnvoll sind.
Final Issues of the 9th Amendment of the German Act Against Restraints of Competition In this paper, the authors analyse the few contentious issues that are left while the 9th amendment of the German Act against Restraints of Competition is about to be finalised. Regarding sanctioning, they argue that the adoption of the European notion of „economic unit“is legally possible and reasonable. They recommend to soften the „gold plating“of the possibility for potential victims of cartels to ask for the disclosure of evidence. The Bundeskartellamt could be vested with powers to sanction violations of consumer law; it is a well-placed agency for this. Yet, law-makers should rather start with small steps than an encompassing empowerment. The authors agree with the proposals to make the procedures for granting a Ministerial Authorisation more transparent. It should go without saying that sectoral exemptions from the competition principle make no sense from a legal and an economic perspective.
