Quelques antinomies dans la protection du paysage en Italie

    Avec cette recherche nous voulons synthétiser le parcours de la protection du paysage qui a été réalisé en Italie et envisager certaines solutions qui pourraient renforcer cette protection. Après avoir brièvement présenté l'évolution, il est souligné que les Régions ont été très superficielles dans la planification, destinée par contre à introduire une régulation spécifique et rigoureuse et vice versa, elles ont favorisé l'urbanisation. Plus de dix ans après l'entrée en vigueur du Code Urbani, la planification est largement inachevée. A notre avis, le rôle de l'Etat doit être renforcé, car il offre plus de garanties par rapport aux autorités locales et régionales. En outre, on devrait simplifier le processus d'autorisation en le concentrant entre les mains de l'Etat. Il est utile d'instaurer un lien intime entre la planification paysagère et urbaine pour faire en sorte que la première ait un rôle déterminant sur la seconde.

    With this research, we aim to summarize the course of landscape protection in Italy and envisage some solutions that could strengthen this protection. Following a brief presentation of its evolution, it is highlighted that the Regions have been quite superficial in planning, otherwise destined in introducing specific and rigorous regulation and vice versa, they have favored urbanization. More than ten years after the entry into force of the Code Urbani, planning is to a great extent incomplete. In our opinion, the role of the State has to be enhanced, since it offers more guarantees compared to the local and regional authorities. Moreover, the process of authorization should be simplified and concentrated in the State. It is useful to establish an intimate bond between the landscape and the urban planning so that the former acquires a key role over the latter.
