Las injusticias de la justicia del retorno forzoso

    El presente artículo tiene como propósito realizar un análisis de la DIRECTIVA 2008/115/CE también conocida como la directiva de “repatriación forzosa”, la cual se ha convertido en uno de los mecanismos de control de la inmigración ilegal adoptado por la Unión Europea, sobre el que recaen denuncias por graves violaciones de los Derechos Humanos. Esta problemática será abordada en este trabajo, desde la relación que establece Foucault, entre poder y Derecho, donde el sistema jurídico se convierte en una manifestación del poder en las “sociedades de control”, pero también es el encargado de legitimarlo y justificarlo. En este sentido, mostraremos mediante casos concretos, como el mal manejo de procedimientos coercitivos por parte de quienes tienen la responsabilidad de efectuar la repatriación, da lugar a la “injusticia de la justicia”.

    The purpose of this article is to give an overview of one of the most controversial legal mechanisms adopted by the European Union to control and regulate illegal migration: DIRECTIVE 2008/115/CE, more commonly known as the “Returns Directive”. The objective of the Directive is to set out “common standards and procedures to be applied in Member States for returning illegally staying third-country nationals”, and it has been widely criticized both inside and outside of the European Union, on the allegations of serious violation of human rights during expulsion proceedings. This issue will be addressed from the relationship established by Foucault, between power and law, in which the legal system is not only a manifestation of power in the “societies of control”, but is also responsible for legitimize and justify it. In this regard, we will show through some specific legal cases, how the mismanagement of enforcement procedures leads to the "injustice of the justice”.
