Resumen de Derecho, identidad, territorio y conflicto: propuesta metodológica para un estudio de caso

El presente trabajo tiene como objetivo contribuir a la creación de una metodología para el análisis de los fenómenos sociales relacionados con la etnicidad, la territorialidad y el derecho en contextos rurales. Desde una perspectiva interdisciplinaria que conjuga los campos de la sociología y la antropología del derecho, se propone como eje central teórico-metodológico la noción del subcampo semiautónomo del derecho para ubicar en un mapa conceptual los fenómenos fundamentales que se manifiestan a través de las disputas por el territorio entre wixaritarí (huicholes) y mestizos. Las interacciones que mantienen dichos grupos aparecen estructuradas por la articulación de los dispositivos operativos del campo y de los subcampos jurídicos: la violencia, la retórica y la burocracia. El dispositivo de la violencia ha sido un elemento fundamental en la estructuración de las relaciones diferenciales entre wixaritarí y mestizos, pues ha contaminado la articulación entre retórica y burocracia, y ha representado una práctica vinculante entre agentes de la comunidad y agentes gubernamentales.

The aim of this article is to create a methodology for the analysis of social phenomena related to ethnicity, territoriality and law in rural contexts. From an interdisciplinary perspective which brings together the fields of sociology and anthropology of law, the article proposes as a theoretical-methodological central axis the notion of the semiautonomous subfield of law to locate —on a contextual map— the fundamental phenomena which are manifested through disputes for territory among the Wixaritari (Huicholes) and the Mestizo population. The interactions that these groups maintain are structured by the articulation of the operating mechanisms of the judicial field and subfields: violence, rhetoric and bureaucracy. The mechanism of violence has been an essential element in the structuring of differential relationships between the Wixaritari and Mestizo population, for it has contaminated the articulation between rhetoric and bureaucracy, and has represented a binding practice between community and government agents.
