The essay discusses two theses on juridical evidence: the ostension thesis and the inference thesis. According to the first, juridical evidence is the abject of an ostension, for it consists in some element susceptible of being shown, or exhibited, or indicated to someone in a given context. According to the second thesis, juridical evidence is the object of an inference, for it consists in the content of a premise which, together with other premises, leads to a conclusion about the disputed facts, or the content of a conclusion the premises lead to. Some objections to the two theses are discussed , and it is claimed that both are necessary for an account of juridical evidence and proof.

Il saggio discute due tesi sulla prova giuridica: la tesi dell'ostensione e la tesi dell'inferenza. Per la prima la prova è oggerro di un'ostensione, in quanto consiste in un elemento suscettibile di essere mostraro, esibito, indicato a qualcuno in un contesto dato. Perla seconda tesi la prova è oggetto di un'inferenza, in quanto è il contenuto di una premessa che, assieme ad altre premesse, conduce a una conclusione in merito ai fatti in esame, oppure è il contenuto di una conclusione a cui conducono date premesse. Vengono discusse alcune obiezioni a queste tesi e viene sostenuto che entrambe sono necessarie per rendere conto della prova giuridica.
