  La Justicia retributiva, basada principalmente, en el castigo al culpable del delito, no está dando los frutosesperados. El nivel de reincidencia de los últimos años, va en aumento. Es por este motivo, por los que la sociedad reclama un cambio en la justicia, en su significado y su eficacia. Por ello, surgen las tesis de corte restaurativa, donde elcastigo del autor deja paso a la reparación del daño y a ofrecer a la víctima un papel protagonista.
