    Este trabajo analiza la sentencia del Tribunal de Justicia de la Unión Europea, de 6 de septiembre de 2016 (C-182/15). Se examina la posibilidad de que el Estado miembro de la Unión Europea que recibe una solicitud de extradición de un tercer Estado, respecto de un ciudadano nacional de un segundo Estado miembro, pueda, en virtud del derecho a la libre circulación y residencia en territorio de la Unión Europea, otorgar preferencia para instar su entrega al Estado miembro del que el reclamado es nacional, previa emisión de la correspondiente O E D E , y siempre que este segundo Estado miembro del que es nacional la persona reclamada, tenga competencia jurisdiccional para enjuiciarle. Se aborda, asimismo, la cuestión relativa a la verificación, por parte del Estado miembro receptor de la petición de entrega extradicional, de que la ejecución de la misma no conllevará riesgos para el reclamado de ser sometido a tortura u otros tratos inhumanos o degradantes, o a ser condenado a la pena capital en el tercer Estado requirente.

    This paper analyses the judgement of the Court of Justice of the European Union, of 6 September 2016 (C-182/15). It examines the possibility that the Member State of the European Union that receives a request for extradition from a third State related to a national of a second Member State, can, under the right to freedom of movement and residence in the territory of the European Union, give preference to urge its delivery to the Member State whose national is claimed , upon issuance of the corresponding European arrest warrant, and provided that the second Member State (the State of the claimed national) has jurisdiction to prosecute that person. It also addresses the issue of verification, on the part of the Member State receiving the request for return, that the enforcement of that delivery will not entail risks for the claimed person of being subjected to torture or other inhuman or degrading treatment, or to be sentenced to capital punishment in the requesting third State
