Resumen de Community Law on rural development under the challenge of the priorities of European Union and International Law

  • This article analyzes rural development policy inthe EU over the last decade, from the point of viewof legal regulation. The current structure and systemof rural development, as well as modifications andadjustments produced on it to meet new challengesand EU priorities for the future are studied. In particular,it deals with the analysis of the overall reformin place of the law on rural development support andthe 2011 proposal for a new Regulation on the matter.The aim of the paper also deals with the various methodsfor the protection of the values represented byintangible cultural heritage and the interaction andthe special relationship between the Convention andother international instruments, particularly its influenceon the rules of the WTO and CAP as agriculturalpolicy that is more integrated policy for all EUpolicies, whose importance is revealed, likewise, thepercentage of the budget which accounts for the EU,which is 40%. The figure shows the importance of itsgoals, specifically, as the last document in Brussels,COM (2010) 672 final-on the challenges of the CAPfor 2014-2020 - in ensuring food security, complianceenvironmental commitments and rural development,this is achieved by legal instruments such as directpayments and market management, in any case, theultimate objective is the competitiveness of the agriculturalsector. These same values are present in theConvention for the Safeguarding of the IntangibleCultural Heritage, how could it be otherwise, sinceagriculture is the source of local traditions and socialidentity, which is trying to promote and maintain theConvention, as a catalyst and control of the processesof globalization and social transformation, as thewealth is cultural diversity. In this way we analyzethe various legal means afforded by the Conventionand the list of intangible heritage, and therefore, theirspecific contributions to the protection of the environmentor environmental policies, and their influenceon rural development, with aim of highlighting itsspecial compared to other international instrumentsand their complementarity
