Resumen de Tribunales informales en Afganistán.: De enemigos a aliados en el proceso de estabilización

  En Afganistán, como en tantos otros países, justicia formal e informal han competido tradicionalmente por el monopolio de la administración de justicia. En una pugna que se inició con el nacimiento del estado afgano, sus gobernantes han tratado de asumir el monopolio de la justicia, desplazando a los sistemas tradicionales. Frente a ellos, tribus y clanes han tratado de preservar su independencia frente al estado, conservando la facultad de administrar justicia. El nuevo régimen surgido tras la caída de los Talibán prosiguió en sus inicios esta tendencia, intentando asumir el monopolio de la administración de justicia. El tiempo pondría de manifiesto que los sistemas de justicia informal, lejos de suponer un obstá-culo para el establecimiento de un estado de derecho efectivo, podrían suponer un aliado; un aliado posiblemente necesario.

  En este trabajo se analizan los razonamientos que han llevado a este cambio de actitud, así como los obstáculos, ventajas e inconvenientes que los intentos por integrar los sistemas formal e informal han puesto de manifiesto en Afganistán.

  As in many other countries, in Afghanistan formal and informal justice have traditionally competed for the monopoly in the administration of justice. In a struggle that began with the birth of the Afghan state, its leaders have tried to assume the monopoly of justice, displacing traditional systems. Before them, tribes and clans have tried to preserve their independence from the state, retaining the power to administer justice. The new regime that emerged after the fall of the Taliban, initially continued this trend, trying to take the monopoly of the administration of justice. Time would show that informal justice systems, far from being an obstacle to the establishment of an effective rule of law, could pose an ally; a potentially necessary ally.

  This work analyzes the rationale leading to this change in attitude, as well as obstacles, advantages and disadvantages that attempt to integrate the formal and informal systems have shown in Afghanistan.
