  This work aims to analyze the international protection of freedom of speech, observing two typical problems of the multicultural society: hate speech and the denial of facts and historical events. Could them be covered by a larger protection of a fundamental right, namely the freedom of thought? What are the legal consequences of prohibiting certain ideas? These are some of the questions that this study aims to answer. As a secondary objective, there is the interest in identifying the limits to the protection of this right, once any fundamental right is absolute, despite freedom of expression can find a historical-political foundation inherent in the idea of democracy.

  Este trabalho visa analisar a proteção internacional da liberdade de expressão, à luz de dois problemas típicos da sociedade multicultural atual: os discursos de ódio e a negação de fatos e acontecimentos históricos. Poderiam estes ser abrangidos pela ampla proteção a um direito fundamental, qual seja a liberdade de expressão de um pensamento? Quais são as consequências jurídicas da proibição de divulgação de certas ideias? Estas são algumas das respostas a que este estudo visa responder. Como objetivo secundário, há o interesse em identificar os limites à proteção desse direito, uma vez que como qualquer outro direito fundamental, seu exercício não é absoluto, embora a liberdade de expressão possa encontrar um fundamento histórico-político inerente à própria ideia de democracia.
