La competencia para conocer del procedimiento de modificación de medidas definitivas. Problemática de los Juzgados de Violencia sobre la Mujer

    Tras la modificación del art. 775.1 LEC el Tribunal Supremo aclara que la competencia para conocer del procedimiento de modificación de medidas definitivas corresponde al Juzgado que dictó la sentencia sin que resulten aplicables las reglas del artículo 769 LEC. Sin embargo, el TS no prejuzga la solución que pueda darse cuando la sentencia inicial fijando las medidas haya sido dictada por un Juzgado de Violencia Sobre la Mujer, que al tiempo de presentar la demanda de modificación de medidas ya no tenga competencia objetiva para temas civiles conforme al art. 87 ter LOPJ. Las Audiencias Provinciales ya están dando respuestas contradictorias sobre la aplicación a estos casos del nuevo art. 775.1 LEC.

    Following the amendment of Section 775.1 of the Civil Procedural Act (LEC), the Tribunal Supremo (Supreme Court) clarified that the jurisdiction for the modification procedure of definitive measures corresponds to the Court which issued the ruling without being applicable the rules of Section 769 of the Civil Procedural Act (LEC). However, the Supreme Court does not prejudge the solution which can occur when the initial ruling setting measures has been issued by a Court for Violence against Women, which at the time of submitting the claim for modification of measures no longer has specialist jurisdiction for civil matters pursuant Section 87b of the Act organizing and planning the justice system - LOPJ. The Audiencias Provinciales (Provincial Courts) are already issuing contradictory rulings on the application to these cases of the new Section 775.1 of the Civil Procedural Act (LEC).
