La AN ha anulado, en sentencia de fecha de 5 de marzo de 2013, el artículo de la Orden Ministerial de Economía de 2011 que otorgaba el control de legalidad a los notarios para denegar la autorización de préstamos hipotecarios cuando éstos incumplieran lo previsto en la legalidad vigente. Esta función vuelve a los Registros de la Propiedad. El fallo también anula el precepto que indica que la resolución por la que el notario deniegue la autorización del préstamo o la inscripción de alguna de las cláusulas del contrato deberá efectuarse mediante escrito motivado, ordenado en hechos y fundamentos de derecho. Dicha decisión era recurrible ante la Dirección General de los Registros y del Notariado (DGRN).
La sentencia tiene su origen en un recurso del Colegio de Registradores de la Propiedad y Mercantiles de España, que solicitaba la nulidad de los apartados 3 y 4 del artículo 30 de la Orden del Ministerio de Economía EHA/2899/2011, de 28 de octubre.
The AN has annulled, in judgment of the Administrative Court, section 3ª, of March 5, 2013, RJCA 2013\178, the article of the Ministerial Order of Economy of 2011 that granted the legality control to notaries to deny authorization of mortgage loans when they failed to comply with the provisions of the Current legality. This function returns to the Land Registrars. The ruling also annuls the precept by which the notary denies authorization of the loan or the registration of any of the clauses of the contract must be made by reasoned document, ordered in facts and legal grounds. This decision was appealed to the General Directorate of Registries and Notaries (DGRN).
