La questione del burqa/niqab in Italia, tra divieti amministrativi e aperture giurisprudenziali

    • The burqa affair has recently become one of the most controversial issues in the European social, political and juridical debate, challenging the role of religion in the public sphere in a multicultural society. This article will consider how the question of regulating the integral veil in public spaces is currently dealt with in Italy. Firstly, Constitutional provisions on freedom of religion or belief will be explained, underlining that the wearing of religious symbols is one of the manifestations of individual freedom of religion and expression. Then municipal ordinances forbidding the integral veils for public security reasons will be taken into account, highlighting the political exploitation of the issue of burqa/niqab in order to respond to �urban fears� at local levels. The different approaches between local politics and the Judiciary will be emphasized, looking at the juridical responses from the Council of State and comparing the Italian Supreme Administrative Court�s rulings with that of the French Conseil d�Etat. Lastly, recent Parliamentary proposals for an absolute ban of the integral veil in public spaces will be analysed, comparing them with the French Law of 2010.
