El nuevo estatuto de las víctimas del delito en el proceso penal según la Directiva Europea 2012/29/UE, de 25 de octubre, y su transposición al ordenamiento jurídico español

    Partiendo de la importancia capital que para fortalecer la posición de las víctimas en el sistema de justicia penal representa la Directiva Europea 2012/29/UE, por la que se establecen normas mínimas sobre sus derechos, apoyo y protección y se sustituye a la anterior Decisión Marco 2001/220/JAI, que regulaba su estatuto procesal, el presente estudio analiza sus derechos a la información, participación, reparación, protección y asistencia. A través de los cuales se define para ellas un nuevo estatuto jurídico en el marco del proceso penal, que persigue individualizar la respuesta a sus necesidades y ofrecer una atención especial a las más vulnerables. Y examina las novedades más sobresalientes introducidas por la Ley 4/2015, de 27 de abril, del Estatuto de la víctima del delito, y el Real Decreto 1109/2015, de 11 de diciembre, para desarrollar sus disposiciones y regular las Oficinas de Asistencia a las Víctimas, normativa con la cual el Estado español ha hecho efectiva su obligación de incorporar el estándar europeo a nuestro ordenamiento jurídico.

    On the basis of the importance that to strengthen the position of victims in the criminal justice system represents the European 2012/29/EU directive, which lays down minimum standards for their rights, support and protection and replaced the previous decision 2001/220/JHA framework, which regulated its procedural Statute, this study analyzes your rights to information participation, reparation, protection and assistance. Through which is defined for them a new legal status within the framework of the criminal process, which aims to identify the response to their needs and offer a special attention to the most vulnerable. And examines the most outstanding novelties introduced by the Law 4/2015, 27 April, of status of the victim of the crime, and the Royal Decree 1109/2015, 11 December, to develop its provisions and regular offices of assistance to victims, regulation with which the Spanish State has made effective his obligation to incorporate the european standard into our legal system.
