    Existe una creciente demanda social en favor del reconocimiento jurídico pleno e institucional del derecho a la identidad de género en los menores de edad en nuestro país. Ante las barreras legales actuales, las familias afectadas se ven obligadas a acudir ante los tribunales ordinarios en amparo de la tutela judicial de dicho derecho, en beneficio de sus hijos e hijas. El reciente auto del Tribunal Supremo de fecha de 10 de Marzo de 2016, plantea una cuestión de inconstitucionalidad ante el TC, en relación al artículo 1 de la Ley 3/2007 Reguladora de la Rectificación Registral de la mención al sexo de las personas, que parece impedir su ámbito de aplicación a los menores de edad. Se trata en esta comunicación de abordar los fundamentos de derecho del TS sobre el derecho a la identidad de género en consonancia con el interés preferente del menor.
