  O estudo analisa algumas das ações afirmativas no decorrer da História do Brasil no sistema de ensino indígena como mecanismo de concretização do Direito Fundamental à Educação. Aborda elementos históricos da Educação Indígena e a positivação deste direito, conferindo caráter fundamental ao direito à Educação. Assim, ao nomear o direito à Educação como Direito Fundamental, indica o papel dos gestores públicos na adoção de políticas delineadas para sua eficácia. O procedimento metodológico utilizado é o analítico-interpretativo de investigação e análise da legislação vigente, inclusive de documentos internacionais internalizados, em especial os correlatos a Legislação Educacional.

  The study examines some of affirmative actions in the course of the history of Brazil in the native indians educational system as a mechanism for implementation of the Fundamental Right to Education. It discusses historical elements of the native indians educational system and the positive legislation, giving fundamental nature of the right to education. Thus, when naming the right to education as a Fundamental Right, the article indicates the role of public managers in adopting policies outlined for its effectiveness. The methodological approach used is the analytical and interpretative research and the analysis of legislation, particularly to Educational Law.
