Resumen de L'Omc et les risques sanitaires: réflexions autour du rapport de l'Organe d'Appel dans l'Affaire « hormones II »

Le 16 octobre 2008, l'Organe d'appel de l'OMC a rendu son rapport dans le litige opposant les Etats-Unis et le Canada d'un cóté et la Communauté européenne de l'autre, concernant les suites du fameux contentieux sur la viande aux hormones. Si ce rapport ne tranche pas !'affaire au fond, il aborde de front la question du mandat des groupes spéciaux de l'OMC face aux éléments scientifiques contenus dans les litiges dont ils sont saisis : recours aux experts, traitement des informations scientifiques, notion d'incertitude scientifique font l'objet d'une mise au point significative par l'Organe d'appel. A travers une condamnation assez ferme du raisonnement développé en premiére instance, celui-ci réaffirme par ailleurs le libre choix du niveau de protection approprié pour chacun des Etats parties.

On October 16. 2008, the Appellate Body of WTO issued its report in the lawsuit opposing the United $tates and Canada on the one hand to the European Community on the other hand and relating to the continuation of the famous dispute on meat with hormones. lf this report does not reso/ve the case, it raises the question of the mandate of WTO special groups having to face the scientific elements pertaining to the lawsuit of which they are seized: appeal to scientific experts, data processing concept of scientific uncertainty are the subject of a significant clari!ication by the Appellate Body. Through a firm criticism of the reasoning developed in the first hearing, this report reaffirms the free choice by each Member State of the suitable level of protection.
