Resumen de Le concept d'État de droit - Hermann Heller : penser l'État de droit démocratique et social en situation de crise

Cette contribution analyse les fondements de la théorie de l'État de droit social, généralement attribuée à Hermann Heller. À cette fin, elle progresse en quatre étapes. On caractérise d'abord la méthode de Heller, en tant que pensée critique et dialectique. On interroge ensuite son concept de l'État. Puis l'on pose le problème de l'unité politique, un problème majeur chez Heller. On précise la distance qu'il prend avec le matérialisme historique. On cherche à comprendre comment s'articule dans son �uvre le règne de la loi et le principe de démocratie pour constituer une certaine idée de l'État de droit. Enfin, on montre comment l'État social doit se comprendre comme démocratie sociale.

This contribution analyzes the foundations of the theory of the social Rechtsstaat, generally attributed to Hermann Heller. To this end, it progresses in four stages. We characterize at first the method of Heller, as a critical and dialectical thought. We question then his concept of the State. Then we raise the problem of the political unity as a major problem in Heller. We specify the distance which he takes with the historic materialism. We try to understand how he articulates in his work the rule of law and the principle of democracy in order to establish a certain idea of the Rechtsstaat. Finally, we show how the social State has to be understood as "social democracy".
